Delay in Montgomery Drug-Charge Hearing
Scotsman World 100metres record holder Tim Montgomery has had had his hearing into drug offence charges delayed. The case, along with that of fellow sprinter Chryste Gaines, had been due to be heard by the Court of Arbitration for Sport on November 1 but both were delayed upon request of all parties. Dates for a new hearing will be announced later. The cases will be heard separately by the same three-person arbitration panel, none of whom reside in the US. The hearings follow an investigation into the Bay Area Laboratory Co-operative (BALCO), whose owners face charges of distributing drugs. None of the those involved, which also include Alvin Harrison and Michelle Collins, have failed a drugs test but the United States Anti-Doping Agency has constructed charges around what it calls “non-analytical positives”, including information gathered during the federal probe into the California laboratory. Harrison was recently handed a four-year suspension after admitting to using a number of performance-enhancing drugs, including anabolic steroids known as the “clear” and the “cream”, insulin, erythropoietin (EPO), growth hormone and modafinil. The 30-year-old had been described as the heir apparent to Michael Johnson after finishing second behind the world-record holder in the 400m at the Olympics in Sydney. Along with his brother Calvin, who is also currently banned for doping offences, Harrison joined Johnson in the victorious relay squad and won gold in both 1996 and 2000. He forfeited all his competitive results and winnings since 1 February 2001. Both Montgomery and Gaines went directly to the CAS, which has the final decision without recourse to appeal, after declining arbitration through the USADA.
