2 3 - 0 6 - 2 0 0 6 Het was Victor Conte Twee verslaggevers, die een boek over Balco hebben geschreven, staan terecht. De rechter gaat ze misschien verplichten om te vertellen van wie ze al de vertrouwelijke documenten kregen waarop ze zich baseren. Maar in het gerechtelijke document over de zaak staat het antwoord al. Je vindt het document in PDF op de website van San Francisco Chronicle, de krant waarvoor de twee journalisten – Mark Fainaru-Wada en Lance Williams – werken. Cruciale passages zijn zwartgemaakt. Maar als je die opveegt met je muis en ze plakt in Notepad of Word, dan kun je de tekst gewoon lezen. Zal wel een technische fout zijn. Met dank aan Tim Fogarty. De Chronicle schrijft op 22/06/2006 een stuk over de zaak. De federale justitie, staat daar in, wil dat de rechter de verslaggevers dwingt te zeggen wie de stukken lekte. De verslaggevers weigeren dat. Natuurlijk. Een goede journalist verklapt nooit zijn bronnen. Maar eigenlijk is allang duidelijk hoe de vork aan de steel zit. De zwartgemaakte stukken vertellen het. Klaar voor wat citaatjes? “On or about October 18, 2003, Conte informed Movants that Barry Bonds had been subpoenaed to testify before the Balco grand jury. In an e-mail from Fainaru-Wada, to Conte on or about March 9, 2004, Fainaru-Wada informed Conte that Fainaru-Wada wanted to continue a dialogue with Conte, off the record, about events in the Balco case. Subsequently, in numerous e-mails “off the record,” Conte informed Fainaru-Wada about secret grand jury proceedings.” Kijk aan. Conte was de bron. Verderop in het document staan de details over het mailverkeer tussen Conte en Fainaru-Wada. Conte geeft Fainaru-Wada informatie over Don Catlin, Trevor Graham, C.J. Hunter, Marion Jones, Barry Bonds en Jason Giambi. Conte maakt dan het grapje dat Fainaru-Wada hem op z’n payroll zou moeten zetten. Op een gegeven moment mailt Conte: “I would say at this point the only way the athletes grand jury testimonies will come out is at trial. Unless I just give you a copy of the indexed CD rom that contains all 30 thousand pages of evidence. How would you like that? Just kidding.” Maar is het wel een grapje? Uit Fainaru-Wada’s antwoord blijkt dat dat de journalist anders hoopt. “So I checked my mail yesterday and I’m still waiting for that CD-Rom. Figured you were gonna Fed-ex it to me. Perhaps it will arrive tomorrow. Or the next day. Or the next. Or the next.” Wanneer die CD uiteindelijk aankomt vertelt het document niet, maar je kunt uit het vervolg opmaken dat dat wel degelijk het geval is. Even later beginnen de grote onthullingen over de Balcozaak tevoorschijn te komen uit de tekstverwerkers van de journalisten van de Chronicle. “On June 24, 2004, immediately after the article containing Montgomery’s grand jury information, Conte sent an e-mail to Fainaru-Wada which he titled “The End,” in which Conte purported to be extremely upset about the article and commented that it was “sad that I can no longer communicate with you.” Still on June 24, 2004, Conte sent another e-mail in which he commented that “maybe you have done me a big favor” because Conte’s lawyer would be filing a motion to dismiss the indictment based on the government leaking the information.” “After the June 25, 2004 hearing at which the Court requested that the government investigate the source of the leak, Conte and Fainaru-Wada communicated about their concerns about what the government might find. On July 1, 2004, Conte informed Fainaru-Wada that Conte believed the government has been monitoring his e-mails.” Dat viel mee, blijkt uit het document. De agenten kregen Conte’s mailwisseling pas in handen op 26 januari 2005. “On January 26, 2005, law enforcement agents from the FBI executed a search warrant at Conte’s residence, pursuant to a warrant authorized by United States Magistrate Judge Bernard Zimmerman. The search warrant authorized agents to seize, among other things, federal grand jury transcripts from various athletes, communications between Conte and members of the media relating to the Balco case and the leaking of grand jury information, and internet postings and e-mails relating to the leaking of grand jury information.” Op 4 augustus gaat de zaak verder. Naschrift: Op 14/2/2007 bekende een advocaat van Balco-medewerker James Valente dat hij, en niet Conte, de documenten had gelekt naar de pers. [Meer] 1. Bob Egelko.
