TORONTO -- A rugged bodybuilder wept yesterday after a judge acquitted him of lurid allegations that he drugged and raped a crack-addicted dominatrix. "I take no pleasure in making an adverse finding of credibility against this obviously troubled soul (the dominatrix)," Justice Bruce Hawkins said as he cleared Gerry Tamburrini of all three charges stemming from the March 31, 2003, incident. "The prosecution has fallen far short of proof beyond reasonable doubt," said Hawkins, dismissing charges of sex assault causing bodily harm, administering a drug and unlawful confinement. Tamburrini, 44, a former bodybuilding competitor and crack user, said it was a night of consensual sex and drugs. The former dominatrix -- who has since changed sexes -- said Tamburrini drugged her with an injection of cocaine and raped her. The witness conceded she fabricated some of what the defence lawyer called "the wild tale of events" as revenge for an unfulfilled relationship with Tamburrini. |
